Terms of Service

1. The agreement

These Terms of Service (“Terms”) are a binding agreement between you and the operator of BreakTemplate (“BreakTemplate,” “we,” “us”) covering your use of breaktemplate.com and every feature it provides, including the break dashboard, stream overlays, calculators, templates, and related tools (together, the “Service”). By creating an account or using the Service you accept these Terms. If you do not agree, do not use the Service.

2. What the Service is

BreakTemplate is software for people who run live sports card and trading card breaks. It tracks break spots, buyers, and finances, and renders live browser-based overlays you can add to streaming software such as OBS Studio. BreakTemplate is a tool for running your business; it is not a marketplace, does not process your buyers’ payments, and is not a party to any sale between you and your buyers.

3. Your account

You need an account to use the app. Authentication is provided by Clerk, our sign-in processor. You are responsible for activity under your account and for keeping your sign-in method secure. Your overlay URLs contain a private token, anyone with the URL can view that overlay, so treat overlay links like a password and regenerate them if exposed. You must be at least 18 years old to create an account.

4. Plans, billing, and trials

The free plan includes one break tracked from the dashboard. The Pro plan is a monthly subscription (currently $19/month) that adds the live OBS overlays, unlimited breaks, on-stream actions, and the full finance suite. Prices may change; we will give existing subscribers reasonable notice before a change affects them.

Payments are processed by Stripe; we never see or store your card number. New Pro subscriptions include a free trial (currently 3 days). Your card is charged automatically when the trial ends unless you cancel first. Subscriptions renew monthly until canceled.

You can cancel anytime from Settings → Billing. Cancellation takes effect at the end of the current billing period, you keep Pro until then, and no further charges occur. Except where required by law, payments already made are non-refundable; if something went wrong on our end, email us and we will make it right.

5. Referral program

Pro subscribers receive a referral code. A referred user gets a discount on their first month; the referrer receives an account credit when the referral converts to a paid subscription. Self-referrals, fake accounts, and abuse void rewards. We may modify or end the referral program at any time, honoring credits already earned.

6. Your content and data

The break data you enter, break names, spot lists, buyer usernames, prices, costs, notes, is yours. You grant us the limited license needed to store it, display it back to you, and render it on the overlays you choose to put on stream. You are responsible for having the right to display any buyer usernames or other information you show on your stream.

7. Acceptable use

Do not: abuse, probe, or overload the Service; attempt to access other users’ data or overlay tokens; resell or white-label the Service without written permission; use the Service for anything unlawful, including breaks that violate the rules of the platform you sell on. We may suspend or terminate accounts that break these rules, with a refund of any unused prepaid period when the violation was not deliberate.

8. Third-party platforms and trademarks

BreakTemplate is an independent product. It is not affiliated with, endorsed by, or sponsored by Whatnot, the NFL, NBA, MLB, NHL, their member teams, players’ associations, card manufacturers, or OBS. All team names and logos displayed on boards are the trademarks of their respective owners, shown at the direction of the user who selected those teams for their break.

Your use of platforms like Whatnot remains governed by their terms; you are responsible for complying with them.

9. Availability and support

We aim to keep the Service fast and available, especially during live shows, but it is provided “as is” and “as available” without uptime guarantees. We ship fixes quickly and read every support message (support@breaktemplate.com and the community Discord), but the Service may occasionally be interrupted by maintenance, upstream provider outages, or forces beyond our control.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The calculators, templates, and guides are informational tools, not financial, tax, or legal advice, and your break pricing and business decisions are your own.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve months before the claim arose. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost sales, or lost data, including losses connected to a live show where an overlay did not behave as expected.

11. Termination

You may stop using the Service and delete your account at any time by emailing us. We may suspend or terminate the Service or your account for violation of these Terms, or discontinue the Service entirely with reasonable notice, refunding any prepaid period we do not deliver.

12. Changes to these Terms

We may update these Terms as the product evolves. Material changes will be announced on the site or by email, and the “Last updated” date above always reflects the current version. Continuing to use the Service after a change takes effect means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the United States and the state in which the Service operator resides, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us and give us 30 days to work it out, most problems are fixable faster than a filing fee.
